Our company is committed to maintaining the confidentiality, accuracy, and security of your personal information. We fulfill this commitment through employee training, the security measures used to protect your information, and our policies, including this Privacy Policy.
Personal information is information about you that can be used to identify you and is protected by law. The Privacy Policy explains:
- How and why we collect, use and sometimes disclose your personal information;
- How and when your informed consent will be sought (and certain exceptions);
- How you can access the personal information we hold about you;
- Who to contact if you have questions or concerns about your privacy.
- Who does this Privacy Policy apply to? Our customers, authorized users of our products and services, and company employees.
- Is this the only Privacy Policy? While this document is intended to be as comprehensive as possible, it cannot cover every situation where we process personal information; therefore, some of our products or services may also have their own privacy policies. Notice of product- or service-specific policies is provided in various ways, depending on the circumstances. These policies are incorporated into this Privacy Policy.
- What information does this Privacy Policy apply to? All personal information we collect, use, or disclose about our individual customers, authorized users, and employees is covered by this Privacy Policy. This information may include your name, mailing address, email address, telephone number, credit information, and billing records. Applicable laws provide certain exceptions to what is generally considered personal information.
- Is all information that identifies me considered protected personal information? Not necessarily. When certain personal information, such as your name, mailing address, telephone number, and email address, appears in a public directory, it is not protected by privacy laws. Your business contact information, such as your name, title, business address, telephone number, and business email address, used in the course of your employment or business, is also excluded. Information that is about you but does not identify you is not considered personal information. For example, information that is about you but has been anonymized so that it does not identify you as an individual is not personal information.
- Do companies need my consent to collect, use, or disclose my personal information? It depends on the type of personal information and the circumstances. If the collection, use, and disclosure of your personal information is reasonable in the circumstances, we will infer your consent based on your actions. For example, if you give us your address, we may use it to send you invoices or other important notices about your products and services, as your consent can reasonably be inferred. In other situations, we may need to obtain your express consent before collecting, using, or disclosing your personal information. For example, we would need your express consent before using your personal information to conduct a credit check. Express consent is when you explicitly agree to the collection, use, and disclosure of your personal information, whether verbally, by signing a document, checking a box, or by taking another similar action that demonstrates your consent. In some situations, it may be impossible or inappropriate to obtain your consent, and in such cases, we may collect, use or disclose your information without your consent. For example:
- to comply with a warrant or other court order;
- to recover a debt;
- to investigate a violation of an agreement or applicable law;
- if otherwise permitted or required by law.
- How do companies obtain my consent? It depends on the circumstances, including the type of personal information collected, used, or disclosed. We may assume your consent if it is reasonable to do so in the circumstances. We may ask for your express consent when our collection, use, or disclosure of personal information is more sensitive or unexpected. Examples of implied and express consent include: When you register as a customer, we rely on your implied consent to track your use of services for the purpose of billing you. However, we would ask for your express consent before using your personal information for individual marketing purposes unless you have already given such consent.
- Under what circumstances do companies collect my personal information? It depends on the purpose of the collection and the product or service concerned. Here are some examples of when we may collect personal information:
- when you provide your personal information, during a process of requesting information, activating or purchasing a product or service;
- when we provide service to our customers, including technical support or during the warranty, repair and service request process
- automatically, when you use our products or services, visit our websites (for example, through the use of cookies or similar technologies)
- from third parties, such as credit reporting agencies, or other third parties with whom you have had a payment relationship.
- How do companies use my personal information? We use your personal information to provide you with our products or services. We may also use your personal information to:
- establish and maintain responsible business relationships with you and provide you with ongoing service;
- understand our customers' needs and preferences and to determine your eligibility for products and services;
- recommend products and services that meet your needs
- design, improve, market or provide products and services
- manage and develop business activities;
- meet legal and regulatory requirements.
If necessary, we will ask for your consent again before using your personal information for any new purpose beyond those listed above.
- When is my personal information disclosed? We may disclose some of your personal information in several situations, for example, when we have obtained your express or implied consent. We may also disclose your personal information to:
- a person acting as your representative (such as a legal representative or an authorized user) if we reasonably believe that the person is authorized to receive your personal information;
- another Communications Service Provider or a Telephone Directory Service Provider, in order to provide efficient and effective communications services.
- third party collection agencies for the purpose of recovering outstanding amounts owed to us;
- third parties, such as credit reporting agencies or anyone with whom you have had a payment relationship, to assess your creditworthiness or assist in collecting overdue amounts owed to us, and to shipping companies in order to ship the products or services you have ordered to you;
- a government or other agency, if reasonably necessary to establish your identity, to investigate a violation of a law or agreement, or to prevent fraud;
- an appropriate public authority, in an emergency situation where there is imminent personal or material danger;
- to a third party (such as a financial institution, government agency, social media or other website) based on the consent you have otherwise given to do so;
- any person to the extent permitted or required by law.
If necessary, we will ask for your consent again before using your personal information for any new purpose beyond those listed above.
- Can I opt out of the collection, use, or disclosure of my personal information by the Companies? Sometimes. You can withdraw your consent or opt out of the collection, use, or disclosure of your personal information in certain situations. You can opt out of using your personal information for a range of our marketing communications, including telemarketing or postal marketing, commercial electronic messages such as emails, and text messages. However, when obtaining your personal information is reasonably necessary to provide you with the services you have requested, you cannot continue to use the Services and opt out of the collection, use, and disclosure of your personal information, as these are terms of service. To stop the collection, use, and disclosure of your personal information in these circumstances, you must terminate your Services.
- How can I learn more about my personal information and verify its accuracy? Simply ask by contacting our senior management. Within a reasonable time following your written request, we will give you the opportunity to review the personal information in your file, subject to certain restrictions and exceptions. If we cannot give you access to your personal information (for example, if doing so would result in the disclosure of someone else's personal information or other confidential or privileged information), we will explain why. Our goal is to ensure that the personal information we hold about you remains accurate, up-to-date, and complete. If you find an error in your personal information, contact us and we will correct it.
- How is my personal information protected? We use appropriate technical and operational safeguards that vary depending on the sensitivity of the personal information in question. All our employees who have access to personal information are required to maintain the confidentiality of that information. Personal information we disclose to third parties is governed by this Privacy Policy, by the application of comparable safeguards in our commercial agreements; it is also protected by additional safeguards, as necessary, depending on the sensitivity of the personal information in question.
- Will my personal information be transferred, stored, or processed outside of Canada? Yes, sometimes. For example, if you use our products to travel outside of Canada. However, your personal information is only shared with our authorized suppliers and agents, who operate abroad with safeguards at least as stringent as those we apply in Canada. Personal information processed outside of Canada may only be used by third parties for the purposes we establish. In such cases, however, your personal information may be subject to the legal jurisdiction of foreign countries.
- How long is my personal information kept? Only for as long as reasonably necessary or relevant for the purposes established or as required by law. When personal information is no longer reasonably relevant, your personal information is destroyed, deleted, or made anonymous.
- Can this Privacy Policy be changed? We may change this Privacy Policy from time to time, in accordance with applicable laws. We will notify you of such changes by posting the change on our website, including a notice in your invoice, sending you an email, or using any other reasonable means.
- What laws apply to the collection, use, and disclosure of my personal information? Our privacy practices are designed to comply with applicable Canadian federal and provincial laws.
- Do you have questions or concerns about our privacy practices? You can contact us at the number indicated on your invoice. If a service representative cannot address your concerns to your satisfaction, please contact senior management. We review all complaints regarding compliance with this Privacy Policy. When warranted, we will take appropriate action to resolve the complaint, including, if necessary, amending our policies and practices.
